SIS Recast Legislative Framework

The Schengen Information System is the largest European system for information exchange in security and border management and has undergone the most extensive evolution since its go live in 2013. New legislation adopted in 2018 introduces new features, users, and functionalities for SIS that are designed to improve EU Member States’ cooperation efficiency in their fight against crime. The implementation of such new features creates a number of challenges for SIS users.  

The new SIS Recast Legislative Framework introduces, amongst other modifications, new responsibilities for data controllers towards citizens with respect to collecting and processing special categories of personal data as defined under GDPR. Increased scrutiny is expected by the relevant Data Protection authorities to ensure respect of citizens and their data subject rights.  

With the upgraded SIS entered into operation on 7 March 2023, Member States must ensure that end users regularly receive training covering data security, data protection and fundamental rights as well as rules and procedures for data processing as stipulated under Article 14 of SIS Recast regulations.
